Occupational Safety and Health Complaints Mechanism


Workers and employees at RSC covered factories, and their representatives, can raise safety and health concerns safely and confidentially through the Occupational Safety and Health Complaints Mechanism (SHCM), supported by a team of RSC staff specialised in investigating and resolving complaints.

Since 1 June 2020, the Occupational Safety & Health Complaint Mechanism has been operated by the RSC. Accord brand and union signatories are tasked with ensuring that the SHCM continues to provide workers with access to remedy, independently and autonomously.

During the course of investigating, RSC complaint handlers will determine the remedy/remediation requirements in regard to safety and health. The RSC team works with complainants and factory management to ensure that the requirements are fully implemented.

If factory management does not comply with the required remediation/remedy of the SHCM, the RSC will implement a notice and warning process, which may lead to the termination of the business relationship.

The Occupational Safety and Health Complaint Mechanism offers workers in the following rights:


  • The right to refuse unsafe work;
  • The right to participate in the work of their factory Safety Committee;
  • The right file a complaint when they see a safety problem in their factory;
  • The right to protection against reprisal for reporting safety-related matters;
  • The right to Freedom of Association in relation to protecting their own safety.

Description

The Complainant alleged non-payment of one month's due earned wages after resigning from his/her employment at the factory, providing the required one month's notice. Reportedly, Factory Management had provided several dates by which the payment would be made. The Complainant's proposed remedy was for Factory Management to immediately pay his/her due earned wages.

Description

The Complainant alleged cracks were observed in the factory building and workers had evacuated the building. Police were, reportedly, at the factory and had instructed the workers to go home.

Outcome

On 21 December 2017, Motaleb Monowara Composite (Pvt) Ltd. was made ineligible for Accord company production. The factory was inspected for fire, electrical and structural safety by the Accord in 2014. The factory failed to make adequate progress in the implementation of its Corrective Action Plan (CAP) and Accord signatory companies using Motaleb Monowara Composite (Pvt) Ltd were therefore required to terminate their business relationship with this supplier. All Accord signatory companies are required to withhold from doing business with this supplier. The Accord ineligibility statement is available at this link: https://accord2.fairfactories.org/accord_v2_files/1/Certificates/162823.pdf. As the factory is not covered by the Accord-RSC, the RSC informed the Inspector General (IG) of the Department of Inspections of Factories and Establishments (DIFE) about the complaint and requested the IG to dispatch a GoB structural safety engineer to investigate the reported issues.

The Complainant stated s/he used the phone on several occasions to attend to an urgent family matter. The Complainant alleged non-payment of due earned wages (for months worked in 2019) and his/her full due separation from employment entitlements, after leaving his/her employment at the factory. The Complainant's proposed remedy was for Factory Management to immediately pay his/her due earned wages and the remainder of his/her due separation from employment entitlements, including service benefits for nearly 8 years of employment at the factory.
